The present Terms and Conditions of Sale are entered into by, on the one hand, BRASSERIE DE TAHITI (BDT), a public limited company with a capital of 8,109,000,000 F CFP, with registered office at 17 Place Notre Dame (BP 597 – 98713 Papeete), Company registration number TPI 53 1 B (RCS) and number 031195 (ISPF), represented by its Deputy Chief Executive Officer, Mr. Bruno BELLANGER, hereinafter referred as “the Seller” or “BDT”, operator of the website www.hinanoworld.com, and, on the other hand, by any individual or legal entity wishing to make a purchase through the website www.hinanoworld.com, referred hereinafter as “the Buyer”.

Article 1 – Purpose

The present terms and conditions of sale set forth the terms and conditions between BDT and the Buyer and the conditions applicable to any purchase made through the website www.hinanoworld.com. By purchasing any item through this website, the Buyer agrees these terms and conditions with unreserved acceptance and acknowledges that he has read them prior to placing an order.

Prior to any transaction, the Buyer declares that (i) purchases of products on www.hinanoworld.com are unrelated to any professional activity and are intended strictly for personal use, and (ii) they are of legal age and/or have full legal capacity to be bound by these Terms and Conditions of Sale.

BRASSERIE DE TAHITI reserves the right to modify these Terms and Conditions of Sale at any time in order to comply with new regulations or to improve the use of its website. Consequently, the applicable terms and conditions will be those in effect on the date the Buyer places the order.

Article 2 – Products

The products offered are those listed on www.hinanoworld.com by BRASSERIE DE TAHITI, subject to availability. BRASSERIE DE TAHITI reserves the right to modify its product range at any time. Each product is descripted on the website with its main technical characteristics (capacity, use, composition, etc.). Photos are as faithful as possible but are for illustrative purposes only.

Products offered over the website www.hinanoworld.com are available for delivery to the countries that fully permit the importation of these products.

Items offered for sale on the website are available for delivery to all countries except the countries of the European Union, the United Kingdom, the French overseas departments and regions (regulatory restriction – Evin law) and the Overseas Collectivities.

Article 3 – Prices

The prices on this website are in euros and include VAT, considering the VAT rate applicable on the day of the order. Any change in the VAT rate may be reflected in product prices. Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an Order Confirmation. The prices on the website exclude delivery costs, which will be added to the total amount due.

Article 4 – Order/Pre-order and Payment Terms

To place an order or pre‑order, the Buyer creates an account on www.hinanoworld.com or places the order/pre‑order as a guest.

Account creation is available directly on the site. To access the account (order status, profile, etc.), the Buyer must log in using their email address and password. BDT offers the Buyer the option to order/pre‑order and pay for products in several steps via secure card payment (CB, VISA, MASTERCARD).

The Buyer selects the products to be ordered/pre‑ordered by adding them to the “cart”, may modify the details of their order/pre-order (quantities, references, etc.), validates the cart and enters or selects the delivery address.

Delivery charges are then calculated and submitted for the Buyer’s acceptance before final validation of the order/pre‑order.

The Buyer then chooses the payment method “Card payment”. The Buyer must follow the steps of the purchase process, completing or verifying the information requested in each step, read the Terms and Conditions of Sale and expressly accept them by checking the corresponding box, before finally confirming the order/pre‑order by clicking the “Confirm my order/pre‑order” button.

The Buyer is then redirected to the SYSTEMPAY secure payment interface, certified PCI DSS, to securely enter their card details. If the payment is accepted, the order/pre‑order is recorded and the sales contract is definitively formed. Payment by credit card is final and irrevocable. In the event of fraudulent use of the card, the Buyer is invited to dispute the payment with their bank, which will inform them of the conditions and procedures for reimbursement. The cardholder’s liability cannot be engaged if the disputed payment is shown to have been made fraudulently, remotely, without physical use of the card.

Confirmation of the order/pre‑order constitutes full and unconditional acceptance of these Terms and Conditions of Sale, acknowledgment of having read them, and a waiver to rely on the Buyer’s own purchasing conditions. All data provided and the recorded confirmation shall constitute proof of the transaction.

BDT will send an email to the Buyer to confirm the registration of the order/pre‑order and to provide delivery tracking information. Article 5 – Retention of Title

BDT retains full and complete ownership of the products sold until the receipt of the total amount due, including costs and taxes.

Article 6 – Delivery time

Deliveries are made to the address provided during the ordering process, subject to delivery restrictions (no deliveries to the countries of the European Union, the United Kingdom, the French overseas departments and regions), and must be located within the agreed geographic area.

Order shipment is carried out by carriers selected by the Third-Part Logistic provider of BDT that operate in the Buyer’s region. Delivery methods vary by carrier and may include pickup location delivery or home delivery, with or without signature required.

Delivery times and delays
Delivery times are provided for information only and do not constitute a firm commitment. The Buyer is provided with a tracking number by email when the order is confirmed to monitore the order processing.

If we fail to deliver the items within thirty (30) days of the date of the order confirmation, the Buyer may cancel the contract and will be totally reimbursed.

Exclusion of liability
BDT cannot be held liable for delays caused by events outside its control, including but not limited to :

    • force majeure events (strikes, severe weather, transport disruptions, etc.) ;
    • temporary unavailability of products from suppliers ;
    • a lack or an error from the Buyer (e.g., incorrect delivery details, prevented or restricted access to the delivery address).

Transfer of risk
Risk of loss or damage to the goods transfers to the Buyer upon delivery of the order. The Buyer must inspect the condition of the packaging and the conformity of the goods within fifteen (15) days from the delivery date shown on the order tracking portal.

Exchanges, returns and refunds
The Buyer has a period of fifteen (15) days from the date of receipt of the order (date shown on the order tracking portal) to return items. Returns must be shipped at the Buyer’s expense to the following address :

Items must be returned in their original condition, unworn, and include all labels. If the original packaging is not available, the order may be returned in alternative packaging provided that it is sealed to prevent loss of items.

Items sent with special packaging (fabric bags, special boxes) or additional accessories must be returned with this special packaging and in the same condition.

If the Seller has made an error in preparing the order or the product is defective, the Buyer will be reimbursed for return shipping costs after verification of the item’s condition, and a replacement item will be sent free of charge. In all other cases, return shipping costs remain the responsibility of the Buyer and will not be reimbursed by BDT.

Article 7 – Warranty

All products supplied by BDT benefit from the statutory warranty provided for in Articles 1641 et seq. of the Civil Code as applicable in French Polynesia. In the event of non‑conformity or defect of a product, it may be returned to BDT, which will, as appropriate, take back, replace or refund the product. Any claim, request for exchange or refund must be sent by post (SA BRASSERIE DE TAHITI, 17 Place Notre Dame, BP 597 – 98713 Papeete, TAHITI, French Polynesia) or by email (customer-service@hinanoworld.com) within a maximum period of thirty (30) days from the date of delivery.

Article 8 – Limitation of Liability

As part of the online sales, BDT is subject to an obligation of means only. BDT’s liability cannot be engaged for any direct or indirect damage resulting from the use of the Internet network, including but not limited to loss of data, intrusion, viruses, service interruption, or any other involuntary incident.

BDT cannot be held liable for any damage resulting from improper use of the products, use inconsistent with their intended purpose, the instructions provided, or applicable regulations.

The Buyer alone is responsible for the choices made when placing an order and for assessing the suitability of the products ordered for their needs.

Article 9 – Intellectual Property

All the components of the website www.hinanoworld.com are and remain the exclusive intellectual property of BRASSERIE DE TAHITI. Any reproduction, representation, exploitation or use, in whole or in part, of these elements, in any form or medium, including photos, logos, visuals or texts, is strictly prohibited without prior authorization.

Article 10 – Personal Data

When visiting the site, creating a customer account or placing an order, the Buyer’s personal data are subject to data processing. BRASSERIE DE TAHITI undertakes to preserve the confidentiality of information provided by the Buyer. All information relating to the processing of personal data is available in the Privacy Policy on the website.

In accordance with the rules in force in France under Regulation (EU) 2016/679 of 27 April 2016, the Buyer has the right of access, rectification, erasure and portability of their personal data. These rights may be exercised by contacting dpo@hinanoworld.com or by post at : SA BRASSERIE DE TAHITI – Data Protection Officer, Legal Department, BP 597 – 98713 Papeete – TAHITI – French Polynesia.

Certain information may be requested for identification purposes in order to process the Buyer’s request and to protect against fraudulent requests.

If the Buyer is not satisfied with the response received, they may file a complaint with the French data protection authority – CNIL (https://www.cnil.fr/en ) or with the supervisory authority of their country.

Article 11 – Dispute Resolution

These Terms and Conditions of Sale are governed by French law, with the specificities applicable in French Polynesia. In the event of a dispute, the parties agree to attempt to resolve the matter amicably. Failing an amicable settlement, jurisdiction shall be vested in the courts of the Seller’s registered office located in French Polynesia.
